Welcome to Sarah Hedden Photography, operated by Sarah Hedden Photography, LLC, a Florida Limited Liability Company (“we,” “us,” “our”). By accessing or using sarahheddenphotography.com (the “Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Website.
Services and pricing
We offer photography services, digital products, and session bookings through the Website and through platforms we utilize for client management and proofing. Pricing is shown on the Website or in a custom proposal. Pricing may change without notice. All prices include applicable taxes unless otherwise stated.
Purchases and payments
Payments may be processed through third-party providers including Square and Stripe. By submitting payment, you confirm you are authorized to use the payment method and that all information is accurate and complete. We are not responsible for the security or privacy practices of third-party processors. Accepted methods may include Visa, MasterCard, American Express, Discover, bank transfer, check, and cash.
Retainers and deposits
A non-refundable retainer may be required to reserve services. The retainer is applied to the total balance. If we must cancel for any reason, your retainer will be refunded or credited toward a rescheduled date.
Cancellations, rescheduling, and late arrivals
Client-requested cancellations forfeit the retainer. Rescheduling requests should be submitted at least 14 days prior to the session when possible. Tardiness may reduce shooting time and sessions end at the scheduled time. If weather, safety concerns, equipment failure, or illness require rescheduling and another date is not possible, a refund of payments made will be issued.
Delivery, editing, and artistic style
All images are edited in our signature artistic style. We retain creative control over artistic decisions, editing approach, and image selection where noted. Raw or unedited images are not provided. Delivery timelines are estimates and not guaranteed.
Copyright and usage rights
All images remain the exclusive property of Sarah Hedden Photography, LLC under U.S. Copyright Law. Clients receive a limited personal-use license for delivered images. Commercial use requires our written license. Unauthorized reproduction, alteration, sale, or distribution is prohibited.
Model release
Unless otherwise agreed in writing prior to the session, you grant permission for the use of images for portfolio display, website and social media, studio samples, and marketing. Confidential sessions must be requested and approved in advance.
Digital file storage
Download and back up delivered files upon receipt. We do not guarantee permanent storage. Archive retrieval, if available, may incur a fee.
Prohibited website uses
- Violating laws or regulations
- Impersonating our business or staff
- Interfering with Website function or security
- Reproducing Website content without written authorization
- Attempting unauthorized access to systems or data
Intellectual property and DMCA
All Website content including text, images, graphics, and designs is owned by Sarah Hedden Photography, LLC and may not be copied or used without written permission. For intellectual property concerns or DMCA notices, contact: sarah@sarahheddenphotography.com.
Third-party links and services
We may link to third-party sites or use third-party services, including Google, Meta, Mailchimp, VSCO, and SiteGround. We are not responsible for their content, security, or privacy practices.
Limitation of liability
The Website is provided “as is,” without warranties. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you for the specific services involved.
Governing law and venue
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Duval County, Florida. Claims must be brought individually and not as a class action.
